Vozač ispred čijeg je osobnog automobila splitskih oznaka 1. rujna 2017. u 20.35 sati, u mjestu Gračac, iskočio srndać i rogovima dodirnuo haubu dobio je odštetu nakon petogodišnjeg postupka na Trgovačkom sudu u Zadru.

Srndać je izletio sa vozačeve desne strane iz niskog raslinja, nakon skretanja za Cerovačke pećine, dok je vozio iz Zagreba prema Kninu. Prethodno ga nije vidio, već je životinja u skoku naletjela na prednji dio vozila nakon čega je vozač naglo zakočio i odbacio srnadaća oko deset metara od automobila. Nakon nesreće se zaustavio na kolniku, dok je srndać kojeg je preuzeo djelatnik cestarske službe – uginuo.

Zbog štete na automobilu osiguranom policom kaska, vozač je tužio Lovačko društvo ‘Ursus lov‘ koje gospodari lovištem "Veliki Urljaj" u čijim se granicama dogodila nesreća. Lovačko društvo je pak opovrgavalo tužbu navodeći kako se nesreća dogodila zbog njegove prebrze vožnje, no prometnim je vještačenjem utvrđeno kako vozač divlju životinju nije mogao izbjeći.

Vještačenjem je utvrđeno da se pridržavao svih prometnih propisa. Vozio je brzinom između 60 i 70 kilokmetara na sat, na mjestu gdje je brzina kretanja ograničena prometnim pravilom od 90 kilometara na sat.

Sud je utvrdio da je vozač, koji tom prilikom nije bio pod utjecajem alkohola, poduzeo sve propisane mjere za sprječavanje štete od divljači, da je postupio adekvatno prometnoj situaciji, da ni na koji način nije doprinio nastanku štete, ali da unatoč tome nije uspio izbjeći nalet svojim vozilom na divljač.

Presudom trgovačkog suda u Zadru Lovačko društvo sada mora njegovom osiguravajućem društvu isplatiti iznos od 23.644,83 kuna.

Vozač ispred čijeg je osobnog automobila splitskih oznaka 1. rujna 2017. u 20.35 sati, u mjestu Gračac, iskočio srndać i rogovima dodirnuo haubu dobio je odštetu nakon petogodišnjeg postupka na Trgovačkom sudu u Zadru.

Srndać je izletio sa vozačeve desne strane iz niskog raslinja, nakon skretanja za Cerovačke pećine, dok je vozio iz Zagreba prema Kninu. Prethodno ga nije vidio, već je životinja u skoku naletjela na prednji dio vozila nakon čega je vozač naglo zakočio i odbacio srnadaća oko deset metara od automobila. Nakon nesreće se zaustavio na kolniku, dok je srndać kojeg je preuzeo djelatnik cestarske službe – uginuo.

Zbog štete na automobilu osiguranom policom kaska, vozač je tužio Lovačko društvo ‘Ursus lov‘ koje gospodari lovištem "Veliki Urljaj" u čijim se granicama dogodila nesreća. Lovačko društvo je pak opovrgavalo tužbu navodeći kako se nesreća dogodila zbog njegove prebrze vožnje, no prometnim je vještačenjem utvrđeno kako vozač divlju životinju nije mogao izbjeći.

Vještačenjem je utvrđeno da se pridržavao svih prometnih propisa. Vozio je brzinom između 60 i 70 kilokmetara na sat, na mjestu gdje je brzina kretanja ograničena prometnim pravilom od 90 kilometara na sat.

Sud je utvrdio da je vozač, koji tom prilikom nije bio pod utjecajem alkohola, poduzeo sve propisane mjere za sprječavanje štete od divljači, da je postupio adekvatno prometnoj situaciji, da ni na koji način nije doprinio nastanku štete, ali da unatoč tome nije uspio izbjeći nalet svojim vozilom na divljač.

Presudom trgovačkog suda u Zadru Lovačko društvo sada mora njegovom osiguravajućem društvu isplatiti iznos od 23.644,83 kuna.

Nakon skretanja za Cerovačke pećine ispred njega iskočio srndać i rogovima mu dodirnuo haubu: evo koliko je trajao sudski postupak za odštetu

Vozač ispred čijeg je osobnog automobila splitskih oznaka 1. rujna 2017. u 20.35 sati, u mjestu Gračac, iskočio srndać i rogovima dodirnuo haubu dobio je odštetu nakon petogodišnjeg postupka na Trgovačkom sudu u Zadru.

Srndać je izletio sa vozačeve desne strane iz niskog raslinja, nakon skretanja za Cerovačke pećine, dok je vozio iz Zagreba prema Kninu. Prethodno ga nije vidio, već je životinja u skoku naletjela na prednji dio vozila nakon čega je vozač naglo zakočio i odbacio srnadaća oko deset metara od automobila. Nakon nesreće se zaustavio na kolniku, dok je srndać kojeg je preuzeo djelatnik cestarske službe – uginuo.

Zbog štete na automobilu osiguranom policom kaska, vozač je tužio Lovačko društvo ‘Ursus lov‘ koje gospodari lovištem "Veliki Urljaj" u čijim se granicama dogodila nesreća. Lovačko društvo je pak opovrgavalo tužbu navodeći kako se nesreća dogodila zbog njegove prebrze vožnje, no prometnim je vještačenjem utvrđeno kako vozač divlju životinju nije mogao izbjeći.

Vještačenjem je utvrđeno da se pridržavao svih prometnih propisa. Vozio je brzinom između 60 i 70 kilokmetara na sat, na mjestu gdje je brzina kretanja ograničena prometnim pravilom od 90 kilometara na sat.

Sud je utvrdio da je vozač, koji tom prilikom nije bio pod utjecajem alkohola, poduzeo sve propisane mjere za sprječavanje štete od divljači, da je postupio adekvatno prometnoj situaciji, da ni na koji način nije doprinio nastanku štete, ali da unatoč tome nije uspio izbjeći nalet svojim vozilom na divljač.

Presudom trgovačkog suda u Zadru Lovačko društvo sada mora njegovom osiguravajućem društvu isplatiti iznos od 23.644,83 kuna.
